These terms govern your use of TrackYourYear. We’ve kept them as short and specific as we can. By using the site you agree to them. If you don’t agree, please don’t use the site.
1. At a glance
- It’s free. No paid plans, no subscriptions, no payment processor.
- It’s as-is. No SLA, no warranty, no commercial guarantees.
- You own what you publish. You give us a licence to display it.
- Don’t abuse it. No illegal content, scraping, or automated abuse.
- Liability is capped at zero USD— the price you pay.
2. Acceptance
By accessing TrackYourYear or using any of its tools you accept these Terms and our Privacy Policy. If you use the site on behalf of an organisation you confirm you have authority to bind that organisation to these Terms.
3. The service
TrackYourYear provides year-progress tracking, countdowns, public holiday data, time-zone clocks, and date and time calculators. We may add, change, or remove features at any time without notice. We may take parts of the site offline for maintenance, security, or because they are no longer useful.
4. No account, no payment
Public visitors don’t need an account. There is no paywall, no credit-card capture, no subscription. The operator-only admin area is reserved for the site maintainer; attempting to access it without authorisation is a breach of these Terms and may also be a breach of applicable computer-misuse law.
5. Acceptable use
You agree not to:
- Scrape, crawl, or otherwise programmatically access the site at a volume that puts disproportionate load on it.
- Use the API or public endpoints to bypass our rate limits, sign-in checks, or content-publishing controls.
- Submit content (in countdowns, contact form, anywhere) that is illegal, infringing, defamatory, fraudulent, hateful, or sexually-explicit.
- Use the site to spam, phish, distribute malware, or impersonate another person or organisation.
- Reverse-engineer, deobfuscate, or attempt to derive source code from any compiled assets we serve.
- Use the site in any way that violates applicable export-control, sanctions, or trade laws.
We may rate-limit, block, or remove content or access at our discretion to enforce these rules.
6. User-published content
When you publish a custom countdown or any other public content through the site:
- You retain ownership of that content.
- You grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, and display the content for the purpose of operating the site.
- You confirm you have the right to publish the content and that it does not infringe anyone else’s rights.
- We may remove or hide any user-published content at our discretion, for any reason, without notice.
7. Intellectual property
The TrackYourYear name, logo, design, layout, and original written content are owned by us. The application source code is proprietary and not publicly available. Holiday data, astronomy data, and timezone data come from third-party open-source libraries and are governed by their own licences. Nothing in these Terms grants you any right to our trademarks.
8. Third-party services and links
The site uses third-party infrastructure providers (listed in our Privacy Policy) and may link to third-party websites. We are not responsible for the availability, accuracy, or content of any third-party site or service.
9. No warranty
The site, its data, and its calculations are provided “as is” and “as available” without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, completeness, non-infringement, and uninterrupted availability.
Holiday dates, time-zone offsets, daylight-saving rules, and astronomy events are derived from open-source datasets and may contain errors. If you depend on any calculation or piece of data here for a decision that has legal, financial, medical, or safety consequences, double-check it with an authoritative source.
10. Limitation of liability
To the maximum extent permitted by applicable law, in no event shall TrackYourYear, its operator, or any contributor be liable for any direct, indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or in connection with the use of, or inability to use, the site — including but not limited to lost profits, lost data, business interruption, or personal injury.
Our total aggregate liability arising out of or relating to these Terms is capped at zero USD, which is the price you pay to use the site. Some jurisdictions do not allow the exclusion of implied warranties or limitation of liability for consequential damages, so the above may not apply to you.
11. Indemnification
You agree to defend, indemnify, and hold harmless the operator from and against any claim, demand, loss, or damage (including reasonable legal fees) arising out of (a) content you publish through the site, (b) your breach of these Terms, or (c) your violation of any law or third-party right.
12. Termination
We may suspend or terminate your access to the site at any time, with or without notice, if we believe you have breached these Terms or if providing the site to you is no longer commercially or technically viable. You may stop using the site at any time. Sections that by their nature should survive termination (IP, liability, indemnification, governing law) will survive.
13. Changes to these terms
We may update these Terms from time to time. The “last updated” badge above reflects the most recent revision date. Material changes will be announced on the site for at least 30 days before taking effect. Continuing to use the site after a change means you accept the updated Terms.
14. Governing law
These Terms are governed by the laws of the Republic of Serbia, excluding its conflict-of-laws provisions. Any dispute that cannot be resolved by good-faith discussion shall be brought in the courts of Belgrade, Serbia. Where mandatory consumer-protection rules in your country of residence apply, nothing in this clause overrides those rights.
15. Severability
If any provision of these Terms is held unenforceable by a court of competent jurisdiction, the remaining provisions will remain in full force. The failure to enforce any right or provision is not a waiver of that right or provision.
